The rules for playing Waybound, in plain language where we can. The most important part is short: watch the road, not the screen.

01Agreement

These Terms of Use are an agreement between you and DesignX LLC (“we”, “us”) for the Waybound app, its iMessage sticker pack and this website (together, “Waybound”). By downloading or using Waybound you agree to these terms and to our Privacy Policy. If you do not agree, do not use Waybound.

02Who can use Waybound

You must be at least 13 years old, or the age of digital consent where you live if that is higher, to use Waybound. If you are under the age of majority where you live, you may use Waybound only with the involvement of a parent or guardian who agrees to these terms.

03Your safety comes first

Waybound is a game played with real exercise in the real world. Please read this section carefully.

  • Not medical advice. Waybound is not a medical device and does not provide medical advice. Distance, pace, heart rate, heart-rate zones and calorie figures are estimates for general fitness and entertainment. Talk to a doctor before starting a new exercise program, especially if you have a medical condition.
  • Exercise at your own risk. Running and walking carry a risk of injury. Know your limits, stop if you feel pain, dizziness or shortness of breath, and dress and hydrate for the conditions.
  • Stay aware of your surroundings. Watch where you are going, not your screen. Obey traffic laws and signals, use sidewalks and crosswalks, and take extra care at night and in bad weather.
  • Never use Waybound while driving or operating a vehicle. Waybound stops counting distance at vehicle speeds, and there is nothing to gain by trying.
  • Not an emergency tool. Waybound is not a safety or emergency device. Do not rely on it to call for help or to share your location with others.
  • Respect places and people. Expedition trails and stops exist only inside the game. They never require you to go anywhere in particular. Do not trespass, enter unsafe areas or break local rules to cover distance.

You choose when, where and how hard you exercise. To the fullest extent permitted by law, you assume the risks of running, walking and being outdoors, and you release DesignX LLC from claims for injury or loss arising from your physical activity, except to the extent caused by our gross negligence or willful misconduct, or where the law does not allow such a release, including for death or personal injury caused by negligence in the UK and EU. Nothing in this section limits rights you have under consumer protection law that cannot be waived by contract, including in New Jersey.

04Your license to use Waybound

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Waybound app for your own non-commercial use on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Your license to the app is governed by Apple's Licensed Application End User License Agreement (the Standard EULA). These terms add rules for the game, this website and share links. If they conflict, the Standard EULA governs your license to the app.

05Game content and virtual items

  • Creatures, pins, Fabled forms, XP, levels and other in-game items and progress are part of the game. They have no monetary value, are not your property, and cannot be sold, traded or exchanged for money or anything of value.
  • We may adjust game content and balance, including discovery odds and expedition lengths, to keep the game fair and working well. If we change discovery odds, we will update the odds shown in the app and on this website at the same time. Displayed odds are base odds. Longer expeditions and the final stop shift them toward rarer finds, and a world's type makes its own creatures more likely, as shown in the app.
  • Your progress is stored on your device. If you delete the app, delete your data, or lose or replace your device without a backup, we cannot restore it.

06Purchases and refunds

If you paid for Waybound, you bought it from Apple under Apple's terms. Refunds are handled by Apple at reportaproblem.apple.com; we cannot issue them ourselves. Waybound has no in-app purchases.

07Your content and share links

Your activities, names, photos and other content you create remain yours. When you share a run or find, the details you chose are encoded in the link, and anyone who has the link can view them on this website. You are responsible for what you share and who you share it with. We may stop displaying any shared content on our website that we reasonably believe is unlawful or abusive.

Copyright and abuse reports. If you believe a shared page on our website infringes your rights or is abusive, email support@waybound.app with the link and your reason, and we may block that link from displaying on our website. We may block a shared link from displaying at any time. Our designated agent for notices under the US Digital Millennium Copyright Act is: Copyright Agent, DesignX LLC, support@waybound.app. Notices must include the information required by 17 U.S.C. § 512(c)(3).

When you share a link, you grant us a worldwide, non-exclusive, royalty-free license to decode and display the content it carries on this website and in link previews, for as long as anyone opens the link.

08Acceptable use

You agree not to:

  • fake or manipulate location or activity data, or use tools to cover distance you did not travel under your own power;
  • copy, modify, reverse engineer or create derivative works of Waybound, except where the law allows despite this restriction;
  • use Waybound or share links for anything unlawful, harmful, harassing or infringing;
  • interfere with or disrupt Waybound or this website, or try to access them in ways we did not intend.

09Intellectual property

Waybound, including its software, worlds, creatures, artwork, names, music and design, is owned by DesignX LLC or its licensors and protected by intellectual property laws. Maps in the app are drawn with MapLibre from tiles served by OpenFreeMap. Map data © OpenStreetMap contributors, available under the Open Database License. If you send us feedback or ideas, we may use them without obligation to you.

10Changes and availability

We may update, change or discontinue any part of Waybound at any time. Some features rely on third-party services, such as map providers, that may change or become unavailable.

11Disclaimers

If you are a consumer in the UK or EU, you have statutory rights for digital content that is faulty or not as described, and nothing in these terms affects them.

To the fullest extent permitted by law, Waybound is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that Waybound will be uninterrupted or error free, or that GPS, heart-rate or other measurements will be accurate.

12Limitation of liability

To the fullest extent permitted by law, DesignX LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, profits or goodwill, arising from or related to your use of Waybound. Our total liability for any claim relating to Waybound is limited to the greater of the amount you paid for Waybound in the twelve months before the claim and US$50.

Some jurisdictions do not allow these exclusions or limits, so some of them may not apply to you. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

13Indemnity

To the extent permitted by law, you agree to indemnify DesignX LLC against claims arising from your misuse of Waybound or your breach of these terms.

14Termination

You can stop using Waybound at any time by deleting the app. We may suspend or end your license if you materially breach these terms. Sections that by their nature should survive, including those on game content, intellectual property, disclaimers, limitation of liability and governing law, survive termination.

15Apple App Store terms

If you downloaded Waybound from the Apple App Store, you and we acknowledge that:

  • These terms are between you and DesignX LLC only, not Apple Inc. (“Apple”). We, not Apple, are solely responsible for Waybound and its content.
  • Your license is limited to using Waybound on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Waybound may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
  • Apple has no obligation to provide any maintenance or support services for Waybound. Support is provided by us, as described on our Support page.
  • If Waybound fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for Waybound. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Waybound, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our responsibility, to the extent not disclaimed in these terms.
  • We, not Apple, are responsible for addressing any claims by you or any third party relating to Waybound or your possession and use of it, including product liability claims, any claim that Waybound fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  • If a third party claims that Waybound or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms of agreement when using Waybound.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.

16Governing law and disputes

Before filing a claim, you agree to email us and try to resolve it informally for 30 days. Either of us may bring qualifying claims in small claims court. To the extent permitted by law, you and we agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class or representative proceeding. If this waiver is found unenforceable for a claim, that claim will be severed and stayed until the individual claims are resolved, and the rest of this section still applies.

These terms are governed by the laws of the State of Ohio, USA, without regard to its conflict of law rules. Any dispute arising from these terms or Waybound will be brought exclusively in the state and federal courts located in Ohio, and you and we consent to their jurisdiction. If you are a consumer living in the European Economic Area, the UK or another country with mandatory consumer protections, you keep those protections and may bring proceedings in the courts where you live.

17Changes to these terms

We may update these terms from time to time. When we do, we will change the date at the top and, for significant changes, give notice on this website and in the app's release notes at least 14 days before they take effect. Continuing to use Waybound after an update takes effect means you accept the new terms.

18General

  • Entire agreement. These terms, the Privacy Policy and Apple's Standard EULA are the entire agreement between you and us about Waybound.
  • Severability. If any provision is held unenforceable, it will be enforced to the maximum extent possible and the rest remain in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign or transfer these terms. We may assign them to an affiliate or to a successor in a merger, acquisition or sale of assets.
